Jetizy Membership Agreement

1. Introduction and Membership

This Jetizy Membership Agreement (hereinafter referred to as the "Agreement") regulates the terms and conditions between Jetizy Information Technologies Marketing and Trade Inc., registered at Ul. Boris Kidrich Street 62/1 Lok. 7 , Tetovo (hereinafter referred to as "Jetizy"), and all natural and/or legal persons (hereinafter referred to as "Member" and/or "Members") who become members by creating an account on the Jetizy website (www.jetizy.com), Jetizy mobile application, or any physical and digital platforms (hereinafter referred to as the "Platform") that may be developed by Jetizy in the future for the provision of Jetizy products and services.

Members acknowledge that they are over 18 years old and have accepted this Agreement's entire content, fully understanding it, and unconditionally accepting all its provisions, either by benefiting from the services offered on the Platform (for a specific fee or free of charge) or by accessing the Platform in any way. These Agreement terms may be unilaterally amended by Jetizy in the future, and Members agree to be considered to have accepted any changes made by Jetizy to this Agreement.

Parents or individuals responsible for caring for or supervising individuals under the age of 18 are obligated to monitor and control the membership or use of the Platform by individuals under the age of 18 and take necessary measures to prevent individuals under the age of 18 from becoming members of the Platform or using the Platform when they deem it necessary. If individuals responsible for caring for and supervising individuals under the age of 18 do not take any measures in this regard or allow individuals under the age of 18 to become members of the Platform or use the Platform with their consent, they shall bear all kinds of responsibility arising from the fact that the individual is under the age of 18. It is recommended that individuals under the age of 13 do not use the Platform.

2. Jetizy Terms of Use

Jetizy Terms of Use ("Terms of Use") are an integral and inseparable part of this Agreement. By accepting this Agreement and becoming a member of the Platform, each Member is deemed to have unconditionally accepted the Terms of Use. The matters regulated by the Terms of Use are binding on the Member without the need for separate mention in this Agreement.

3. Intellectual Property Rights

All content on the Platform is subject to the Law on Intellectual and Artistic Works, and all kinds of audio, visual, written, documentary, and all intellectual and industrial property rights and all copyright and other intellectual and industrial property rights related to its content belong to Jetizy. The structure and content of this Platform, as well as all visual materials used on the site, are protected within the scope of the Law on Intellectual and Artistic Works and the Turkish Penal Code.

No content on the Platform may be modified, copied, reproduced, translated into another language, republished, loaded onto another computer, posted, transmitted, presented, or distributed in any form, including but not limited to, without prior permission and without attribution, including code and software, in whole or in part, on another website or application without permission.

4. Platform Usage Rules

To become a member of Jetizy, it is mandatory to complete all the required information in the user information form on the Platform accurately and clearly. Members unconditionally commit to the accuracy of the information provided through this form.

Jetizy shall not be used for political purposes, attacks, or protest purposes.

Jetizy respects the personality and privacy rights of all Members. Except for the reasons stated in this Agreement and without a request from judicial authorities, Jetizy accepts and commits not to provide personal information to any institution or organization for any reason whatsoever.

Jetizy shall not be held responsible for the consequences of attacks on the database resulting in the malicious use of Members' information by malicious individuals.

The Member may engage in transactions on the Platform for legitimate purposes. The Member is solely responsible for the legal and criminal consequences of their actions and transactions within the Platform. The Member acknowledges and commits not to reproduce, copy, distribute, process, transfer to another database, or upload to the Platform in a manner that may produce such results any images, texts, visual and auditory images, video clips, files, databases, catalogs, and lists found on the Platform, whether owned by Jetizy or any third party, which could infringe on the personal or proprietary rights, assets, or personal data of Jetizy and/or any other third party, and that they will not engage in any actions or transactions that directly and/or indirectly constitute unfair competition, either through these actions or in any other way. Jetizy shall not be held responsible for any damages suffered by third parties as a result of the activities of the Member on the Platform, which are contrary to this Agreement and the law.

The Member acknowledges that Jetizy has no liability for defects in goods and services received from third parties and that any requests and responsibilities under the legal regulations regarding these goods and services belong to the seller of the relevant goods and services, and waives Jetizy from any liability and obligation in this regard.

No violation of copyright or intellectual property rights shall occur in any use and software. Any copyright and human rights liability for the content added by Members belongs to the respective Member. Therefore, those who suffer from the actions in question cannot make claims against Jetizy. Jetizy and the Member are legally independent parties. There is no partnership or employer/employee relationship between these two independent parties.

The Member shall not post or transmit any information through the site or application's interactive areas that could constitute a crime, require legal action, or contradict local and national laws or international agreements, or create such situations or encourage such situations, and shall not post or transmit any information that is illegal, threatening, harassing, insulting, offensive, obscene, pornographic, disturbing, or contrary to morality through the interactive areas on the Platform.

Members are responsible for the content they publish and share on the Platform, within the framework of the provisions listed below in accordance with the Turkish Penal Code dated 26/9/2004:

- Encouragement to Suicide: Inciting, encouraging, or strengthening someone else's decision to commit suicide is a crime and unacceptable.
- Sexual Abuse of Children: Any sexual behavior towards children who have not yet reached the age of fifteen, or who, although they have reached this age, have not developed the ability to perceive the legal meaning and consequences of the act, is a crime and unacceptable. Sexual behaviors against other children, based only on force, threat, fraud, or any other reason affecting the will, are also considered crimes and are unacceptable.
- Facilitating Drug or Stimulant Use: Providing special places, equipment, or materials for the facilitation of drug or stimulant use or providing information to others about methods of use is a crime and unacceptable.
- Supplying Dangerous Substances for Health: Providing substances that may endanger health to children, mentally ill individuals, or volatile substance users is a crime and unacceptable.
- Obscenity: The publication or sharing of obscene images, writings, or words is a crime and unacceptable.
- Prostitution: Encouraging, facilitating, or mediating prostitution for a child or a person is a crime and unacceptable.
- Providing a Place and Opportunity for Gambling: Providing a place and opportunity for people to gamble is a crime and unacceptable.
- Crimes Against Mustafa Kemal Atatürk: Insulting or defaming Mustafa Kemal Atatürk's memory is a crime and unacceptable.

Jetizy advises all Members not to share their personal information with other users to protect their privacy. Jetizy shall not be held responsible for any harm or adverse situations that may arise from Members' information sharing among themselves.

Jetizy is not responsible for what Members write in the interactive areas on the Platform. It is not obliged to share the opinions expressed there. Jetizy reserves the right to remove content from the Platform without any justification. Jetizy may use this right without any notice or prior approval. Members are obliged to fulfill the changes and/or corrections requested by Jetizy promptly. If necessary, Jetizy may make these changes and/or corrections itself. Any damages, legal and criminal liabilities arising from the failure of users to fulfill the changes and/or corrections requested by Jetizy, due to their actions contrary to this Agreement and unlawful activities on the Platform, shall be entirely borne by the users.

Jetizy shall not be held responsible for unauthorized persons reading Member data (sharing Member information with others, not logging out when leaving the site, leaving the open application on the phone in a public area, or theft, etc.) leading to damages.

Jetizy has no responsibility for the behavior of any Member on the Platform. Under no circumstances shall Jetizy be liable for any loss, damage, harm, death, etc., resulting from the use of the Platform, its content, online or offline location, communication, and interaction among Members, regardless of the nature of the actions or transactions between Members, who are responsible for these actions and transactions.

Jetizy may collect your information such as device, location, and network usage data, by anonymizing it to improve service quality without violating your privacy, to increase the performance of the services and content on the Platform. Jetizy may use this anonymous information for statistical and performance evaluations, annual reports, and similar reports, marketing campaigns of Jetizy and its business partners, and the marketing of data services of mobile operators and may keep, process, and transmit them to business partners for the necessary period. The use of this information will be subject to the Privacy Policy. Please read the Privacy Policy carefully.

Jetizy reserves the right to change the services and content offered on the Platform at any time; to close access to the information and content uploaded to the system by the Member, including other users, and to delete it. Jetizy has the right to use this right without giving any notice and without delay. The Member is obliged to fulfill the changes and/or corrections requested by Jetizy promptly. If necessary, Jetizy may make these changes and/or corrections itself. Any damages arising from the failure of the users to fulfill the changes and/or corrections requested by Jetizy, due to their actions contrary to this Agreement, and the legal and criminal liabilities that may arise from these actions are entirely the responsibility of the users.

5. Membership Account

The member has a "password" determined by themselves. In addition, the email address used during registration on the Platform is unique to the member, and only one membership can be created with this email address. The "password" is known only to the member.

The member has the right to change their password at any time. The selection and keeping/protection of the password is the responsibility of the member. Jetizy will not be responsible for any problems arising from the use of the password. To access Jetizy services that require membership, the member must enter the email address and password they provided during registration.

Jetizy has the right and authority to cancel the memberships of any member, change the shape of the service it offers, and/or cancel it without giving any reason.

The member acknowledges and undertakes that the information and content provided by them are correct and in compliance with the law, and that the publication of such information and content on the Platform or the sale and display of products related to these contents does not constitute a violation of the current legislation. Jetizy is not responsible for investigating the accuracy of the information and content transmitted to the membership account by the member or uploaded by the member via the Platform, nor is it responsible for any damage that may arise from the incorrect or erroneous nature of such information and content, or from its publication.

In cases where the member is legally obliged to provide explanations to official authorities, the member acknowledges and undertakes that Jetizy is authorized to disclose the member's information to official authorities, and therefore, the member will not claim any compensation from Jetizy under any name.

6. Miscellaneous

In all cases legally considered as force majeure, Jetizy is not liable for the non-performance, delay, or non-performance of any of the obligations set forth in this Agreement. Such situations, including but not limited to natural disasters, riots, wars, strikes, communication problems, infrastructure and internet failures, malfunctions that may occur due to improvement or renovation work on the system, power outages, and adverse weather conditions, will not be considered as delay, incomplete performance, or non-performance or default on the part of Jetizy, and no compensation can be claimed from Jetizy under any name. The term force majeure will be interpreted as events that are beyond the reasonable control of the relevant party and that Jetizy, despite taking due care, could not prevent.

This Agreement will enter into force indefinitely between the parties after being approved by the Member.

The email address notified by the Member to Jetizy is considered as the electronic mail address to be requested as the legal address for any kind of notification to be made within the scope of this Agreement. Jetizy will be deemed to have reached the Member one (1) day after the email sent to this email address.

7. Appendices,

The attachments listed below and linked are integral and inseparable parts of this Agreement. The Member is obliged to strictly comply with the rules specified in these attachments, depending on the type of membership created and the activities to be carried out on the Platform.
