Jetizy Term of Use

1. DEFINITIONS

Jetizy	Jetizy Information Technologies Marketing and Trade Inc., located at Ul. Boris Kidrich Street 62/1 Lok. 7 , Tetovo.
Platform / Portal	The website with the domain name www.jetizy.com, the Jetizy mobile application, and any online medium through which Services are provided by Jetizy.
Terms of Use	These Jetizy Terms of Use.
User	Any natural or legal person accessing the Platform.
Account Holder	A User with an account on the Platform who benefits from the Services provided within the scope of these Terms of Use and the Membership Agreement's conditions.
Membership Agreement	The Jetizy Membership Agreement that any User must accept to become an Account Holder and to use the rights granted to the Account Holder, in accordance with these Terms of Use.
Services	Applications provided by Jetizy within the Platform to enable Account Holders to perform the activities defined within these Terms of Use. Jetizy may make changes and/or adaptations to the Services offered within the Platform at any time. The rules and conditions that the Account Holder must comply with regarding the changes and/or adaptations made are announced to the Account Holder through the Platform, and the terms and conditions disclosed are effective as of the date they are published on the Platform.
Content	Any type of information, text, file, image, video, number, etc., that is published on the Platform and accessible, including visual, textual, and auditory elements.
Jetizy Interface	Internet pages that enable Users to view the content created by Jetizy and the Account Holder and to query the Jetizy Database, all of which are designs owned by Jetizy and used by Users for performing any kind of transaction through the Platform by sending commands to the computer program.
Jetizy Database	The database owned by Jetizy, in which the contents accessed within the Platform are stored, queried, and accessible, along with its protection.

2. INTRODUCTION

Please read the conditions written below in order to use the Platform. By visiting and/or using the Platform and/or becoming an Account Holder, you acknowledge that you have read these Terms of Use, fully understand their content, unconditionally accept all the provisions specified in the Terms of Use, as well as those stated on the Platform and those that will be added over time without any objections or defenses concerning all the matters specified on the Platform. If you do not accept these conditions, please refrain from using the Platform.

The owner and operator of this Platform is Jetizy. The Services provided on the Platform, as specified in Article 4 of these Terms of Use, are provided by Jetizy.

Jetizy may change these Terms of Use, all kinds of information, and Content on the Platform at any time without notifying or notifying the User. These changes will be periodically published on the Platform and will be effective on the date of publication. Any natural or legal person who benefits from the Services by paying a certain fee or free of charge, or who accesses the Platform in any way, is considered to have accepted these Terms of Use and any changes made to these Terms of Use by Jetizy. These Terms of Use have been made accessible to every natural or legal person using the Platform by being published on the Platform.

3. USERS

Users, by benefiting from the services offered on the Platform or by accessing the Platform in any way, acknowledge that they are over 18 years of age, that they have read and fully understood these Terms of Use, and that they unconditionally accept and approve all of its articles.

Parents or individuals responsible for caring for or supervising individuals under the age of 18 are responsible for monitoring and controlling the membership of individuals under the age of 18 on the Platform or their use of the Platform, and are obliged to take necessary measures to prevent individuals under the age of 18 from becoming members of the Platform or using the Platform when they deem it necessary. If the individuals responsible for caring for and supervising individuals under the age of 18 do not take any precautions in this regard or allow individuals under the age of 18 to become members of the Platform or use the Platform with their consent, any liability arising from the fact that the person is under the age of 18 belongs to the individuals responsible for caring for and supervising themselves.

Users are obliged to fill in the required fields completely and clearly when entering information on the Platform. Users unconditionally commit to the accuracy of the information they provide. If the information provided is incorrect or belongs to third parties, the responsibility arising from this lies with the User.

4. JETIZY SERVICES

Jetizy ensures that the content uploaded to the Jetizy Database by the Account Holder can be viewed by Users through the use of the Jetizy Interface on the Jetizy Database.

Jetizy provides various types of listing services prioritizing the display of advertisements to make it easier for Users to access Account Holder listings within the Platform.

Jetizy offers reporting services under various categories for transactions carried out within the Platform, including the number of views.

Jetizy reserves the right to add new Services within the Platform, change the scope and delivery conditions of existing Services, and may restrict access or delete Content accessible within the Platform, without prior notice or consent, as it sees fit.

5. PORTAL USAGE RULES AND OBLIGATIONS

Users may conduct transactions on the Platform for lawful purposes. Users are solely responsible for the legal and criminal liability for any transactions and actions they take on the Platform, and Users acknowledge, declare, and undertake that Jetizy has no responsibility regarding such legal and criminal obligations.

The Platform operates on the principle of displaying the Content uploaded to the Jetizy Database by the Account Holder. Jetizy does not guarantee the accuracy, truthfulness, security, or legality of the advertisements and Content viewed by Users under any circumstances. Users accept and declare that Jetizy has no responsibility for such advertisements and Content and that Jetizy will have no liability for any damages that may arise.

Users undertake and commit not to reproduce, copy, distribute, process, or engage in any commercial activity by using any images, texts, visual and auditory images, databases, catalogs, and lists found within the Platform, and not to engage in any behavior or actions that may constitute unfair competition, whether directly or indirectly.

Users undertake not to engage in activities within the Platform that may lead to unfair competition, damage the personal and commercial reputation of Jetizy and/or third parties, infringe or assault personality rights, act in accordance with the legislation, public order, and general morality rules, take the necessary measures required by the legislation, and fulfill the procedures, and not to engage in any unlawful, criminal, disturbing, personality-damaging, infringing on intellectual property rights, copyright, trademark rights, and property rights, as well as not to publish content that would constitute discrimination based on gender, race, color, language, religion, belief, sect, philosophical and political opinion, ethnic origin, wealth, birth, marital status, health status, disability, and age, and not to engage in behavior and actions related to this.

Users are obligated to use the information they access within the Platform only in accordance with the purpose intended by the disclosing Account Holder or Jetizy, and for non-commercial purposes. Contact information provided in advertisements by the Account Holder may be used for the purpose of contacting and obtaining information about the advertisement.

Jetizy may use, process, share, classify, and store User information for communication activities, marketing activities, and statistical analysis, as well as to create and maintain a database and for promotional and informative purposes. Jetizy may also use information such as the user's IP address, which sections of the Platform they visited, domain type, browser type, date, and time for statistical evaluation and for providing personalized services and offers. For the purpose of improving its processes, Jetizy may collaborate with companies to conduct research, create a database, and conduct market research, and may transfer User information to these companies, and User information may be processed by these companies for the limited purposes mentioned above.

Accessing and/or viewing the Content stored in the Jetizy Database, which is accessed and/or viewed through the Platform, is lawful only for the purpose of viewing the relevant Content and/or for third parties to access it in accordance with Jetizy's Terms of Use. Accesses other than this are illegal, and Jetizy reserves all rights for any claims, lawsuits, and follow-ups.

Jetizy allows viewing advertisements and using the Jetizy Interface for the purpose of learning the content of the advertisements. However, any attempts to access advertisements through the database with a specific number or all of them for purposes other than this, partial or complete copying of advertisements, customer information, designs, codes, and software in the Jetizy Database, their publication directly or indirectly on other platforms, compilation, processing, modification, transfer to other databases, opening access and use by third parties, including linking to advertisements on Jetizy, are not permitted by Jetizy and consent is not given. Such actions are illegal, and Jetizy reserves all rights for any claims, lawsuits, and follow-ups.

The use of the entire Platform or any part of it for the purpose of disruption, modification, reverse engineering, or attempting to break API protocols through reverse engineering methods or any other method, unauthorized access to parameters such as API key, API secret key, request headers, client authentication algorithm, or unauthorized sharing of these parameters with third parties, attempting to gain access to the Platform in a manner that disrupts or interferes with the communication or technical systems of the Platform or any form of interference with the systems, attempting to access the Platform through automatic programs, robots, spiders, web crawlers, data mining, data scanning, "screen scraping" software or systems, automatic tools, or manual processes, unauthorized access to other users' data or software, running bots based on various criteria, DDOS attacks, and any other attacks or unlawful uses against the system as a whole or in part, disrupting, modifying, reducing the existing performance, or destroying it, and any other attacks and other unlawful uses of the system will be blocked at the discretion of Jetizy. Even in the absence of such uses, Jetizy may, in its discretion, only allow access to the Platform after the Account Holder logs in with their username and password. Using the Platform and the Content on the Platform outside the usage limits set forth in the Terms of Use for the Platform is illegal, and Jetizy reserves all rights for any claims, lawsuits, and follow-ups. In the event of the detection of such unauthorized use, Jetizy has the right to report the User to the competent authorities. The User acknowledges that they are personally responsible for any damages and claims arising from such uses.

The User acknowledges and undertakes that Jetizy shall not be held responsible for any direct or indirect damages that may arise in case of interruptions in the Services provided on the Platform, disruptions in information transmission, delays, failures, and data loss.

Users shall not post or transmit any information through the interactive areas on the Platform that may constitute a crime, require legal action, contradict local and national laws, or international agreements, or that create or encourage such situations, as well as any illegal, threatening, disturbing, offensive, defamatory, vulgar, pornographic, disturbing, or morally objectionable information. Users shall not engage in actions or behaviors that violate the rights of Jetizy, other Users, or third parties.

Users shall not post or transmit any information, software, or other materials derived from materials that violate the privacy rights or publication rights of others, are protected by copyright, trademark rights, or other property rights, or fall into the described categories without permission from the owner or rights holder.

6. INTELLECTUAL PROPERTY RIGHTS

The software that constitutes the Platform and all the content within the Platform are subject to Law No. 5846 on Intellectual and Artistic Works, and all intellectual and industrial property rights, as well as all copyright rights, related to its content, including any sound, image, text, document, idea, know-how, and other intellectual and industrial rights are exclusively owned by Jetizy or the third parties who have provided them to Jetizy under contractual agreements. The structure and content of the Platform, all photographs, videos, visuals, texts, and other works protected by intellectual property rights used in the Platform are protected under the Law on Intellectual and Artistic Works.

No photograph, video, visual, text, or other work protected by intellectual property rights found in the Platform can be modified, copied, reproduced, translated into another language, republished, uploaded to another computer, posted, transmitted, presented, or distributed without prior permission and without attribution, including code and software.

Users must ensure that the content uploaded to the Platform by them, which qualifies as a work under the Law on Intellectual and Artistic Works and other relevant legislation and is subject to copyright, does not infringe the copyright and other rights of third parties or violate the law. Otherwise, if a copyright owner or its representative or any other third party informs Jetizy that the Platform is being used for an unlawful purpose or a rights violation, or if such a situation is proven by a court decision or the admission of the relevant User, or if Jetizy becomes aware of such a situation in any way or if there are signs indicating the existence of such a situation, Jetizy may cancel the access and/or usage rights of that User to this Platform.

7. OTHER PROVISIONS

Jetizy reserves the right to unilaterally change these Terms of Use at any time by announcing them on the Platform. The amended provisions of these Terms of Use will become effective on the date of their announcement.

In cases legally considered as force majeure, Jetizy will not be liable for late performance, incomplete performance, or non-performance. Force majeure will be interpreted as events that are beyond the reasonable control of the relevant party and that Jetizy could not prevent despite exercising due diligence, including but not limited to natural disasters, war, fire, strikes, riots, revolutions, adverse weather conditions, infrastructure and internet failures, system improvement or upgrade work, and any kind of failure that may occur as a result of these, as well as power outages.

In the application, interpretation, and resolution of legal relationships arising from these Terms of Use, Turkish Law will be applied unless there is a mandatory provision to the contrary. All rights of Jetizy Macedonia company belong to Jetizy Turkey, and in case of any dispute arising from or related to these terms of use, the Courts and Enforcement Offices of Istanbul are authorized.

These Terms of Use and any amendments made therein shall come into effect on the date they are published on the Platform. By using the Platform, Users are deemed to have accepted these Terms of Use and any changes made to them over time.
